1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Mount Hydra Corp. ("Mount Hydra," "we," "our," or "us") governing your access to and use of the websites located at shop.mounthydra.us and mounthydra.us (collectively, the "Site"), as well as any products or services offered through the Site.

By accessing or using the Site, placing an order, or submitting a professional inquiry, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Site.

2. Professional Use Only

Mount Hydra products are professional cosmetic ingredients formulated exclusively for use by or under the direct supervision of licensed aesthetic professionals, including but not limited to licensed physicians, nurse practitioners, physician assistants, registered nurses, licensed estheticians, and licensed medical spas operating in compliance with applicable state and federal law.

By placing an order or submitting a professional inquiry, you represent and warrant that:

3. Products and Orders

Product Descriptions

We make every effort to accurately describe our products. Product images are for illustrative purposes only. Mount Hydra reserves the right to modify product formulations, packaging, and specifications without prior notice.

Order Acceptance

Your order constitutes an offer to purchase. We reserve the right to accept or decline any order at our sole discretion, including orders where professional verification cannot be completed, where payment cannot be processed, or where products are unavailable.

Pricing

All prices are listed in US dollars and are subject to change without notice. Applicable taxes and shipping fees will be calculated and displayed at checkout. We reserve the right to correct any pricing errors, even after an order has been placed.

4. Payment

Payment is due in full at the time of order. We accept major credit cards and other payment methods as displayed at checkout, processed securely through Stripe. By providing payment information, you authorize Mount Hydra to charge the full order amount to your designated payment method. All transactions are subject to Stripe's terms of service.

5. Shipping and Delivery

Mount Hydra ships products via FedEx overnight cold chain delivery to maintain product integrity. Orders placed before 2:00 PM Eastern Time on business days are generally processed for same-day shipment, subject to product availability and professional verification completion.

Delivery times are estimates and are not guaranteed. Mount Hydra is not responsible for delays caused by carrier issues, weather events, customs, or other circumstances beyond our control. Risk of loss and title for products pass to you upon delivery to the carrier.

6. Returns and Refunds

Due to the nature of our professional cosmetic ingredient products and cold chain requirements, all sales are final. We do not accept returns of opened or used products.

If you receive a product that is damaged, defective, or incorrect, please contact us at [email protected] within 48 hours of delivery with photographic evidence. We will review each claim on a case-by-case basis and, at our discretion, offer a replacement or store credit.

7. Regulatory Compliance and Intended Use

Mount Hydra products are cosmetic ingredients intended for professional use only. They are not drugs, medical devices, or biologics, and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. These products have not been evaluated by the U.S. Food and Drug Administration (FDA) for any drug or medical purpose.

You are solely responsible for ensuring that your use of Mount Hydra products complies with all applicable federal, state, and local laws and regulations, including professional licensing requirements, scope of practice regulations, and applicable cosmetic regulations.

8. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, product formulations, and software, is the property of Mount Hydra Corp. or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.

9. Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MOUNT HYDRA DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOUNT HYDRA CORP. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

11. Indemnification
